These General Rental Conditions govern the vehicle rental services offered by:

Hiring a vehicle implies acceptance of these conditions, without prejudice to any specific conditions that may appear in the booking or rental agreement.
1. Booking and vehicle group
The booking is made for a vehicle group or category, not for a specific make, model, colour or registration number.
The photographs and models shown on the website are for guidance only and represent vehicles belonging to the selected group.
Autos Flores will endeavour to provide a vehicle from the reserved group. If this is not possible for operational or availability reasons, another vehicle with similar characteristics or from a higher group may be provided at no additional cost to the customer.
The essential characteristics included in the reserved group must be respected. For example, if the customer books an automatic vehicle, an automatic vehicle will be provided; likewise, if a manual vehicle is booked, that characteristic will be respected.
If, exceptionally, it is not possible to maintain an essential characteristic of the booking, Autos Flores will inform the customer and offer the available alternatives.
2. Driver age and experience
The standard age for renting and driving an Autos Flores vehicle is 25 to 80 years, both inclusive.
Drivers aged 81 to 85 may be accepted with a surcharge of €5 per day, up to a maximum of €100 per rental.
All drivers must hold a valid driving licence and have at least 2 years of driving experience.
Drivers outside the stated age ranges or who do not meet the minimum experience requirement will not be accepted.
3. Driving licence and documentation
All drivers must present a driving licence valid for driving in Spain and the identification documents required by Autos Flores.
Where, due to the country of issue or applicable regulations, an International Driving Permit or additional documentation is required, the driver must present it together with the original driving licence.
All documentation must remain valid throughout the rental period.
4. Authorised drivers and responsibility
Only persons expressly listed as authorised drivers in the rental agreement may drive the vehicle.
The vehicle may not be driven by anyone who is not listed as an authorised driver.
The contract holder will be primarily responsible for complying with the obligations arising from the rental.
Each authorised driver will be responsible for acts, damage, infringements or breaches directly attributable to them while driving or using the vehicle.
Where an obligation or damage arises from the actions of an authorised driver and is enforceable under the agreement, the contract holder and that driver may be liable to Autos Flores in accordance with applicable law.
5. Credit card as a contractual guarantee
Autos Flores does not block any amount on the credit card and does not require a deposit as an insurance excess.
To formalise the rental, the details of a valid credit card belonging to the contract holder will be required. The contract holder is the person who signs the rental agreement and accepts the obligations arising from it.
The card is requested solely as a contractual guarantee and may only be used to make duly justified charges relating to items not covered by insurance or resulting from a breach of the rental conditions, including, among others:

fines and administration charges;
-
missing fuel;
-
loss of or damage to keys;
-
damage or costs resulting from prohibited use or contractual breaches;
-
other amounts expressly provided for in these conditions or in the rental agreement.
Autos Flores may request the card number and expiry date as a contractual guarantee. The CVV/CVC security code will never be requested or stored.
The requirement to provide a credit card as a guarantee does not imply the existence of an insurance excess or the blocking of a deposit.
6. Payment methods
Autos Flores accepts the following payment methods:

Visa and MasterCard.

Online payment through the payment gateway provided by Autos Flores.
-
Cash, within the limits and requirements established by current Spanish legislation.
-
Bank transfer.
American Express cards are not accepted.
Customers wishing to pay by bank transfer must contact Autos Flores in advance to request the current IBAN and the instructions required to identify the booking and payment correctly.
The use of a specific payment method may be subject to the conditions communicated during the booking process or before vehicle delivery.
7. Vehicle delivery and initial condition
At the time of delivery, the customer will receive the vehicle in appropriate operating and cleanliness condition, together with the corresponding documentation, keys, accessories and equipment.
The condition of the vehicle, fuel level and, where applicable, existing damage or incidents may be recorded in the rental agreement or in the systems used by Autos Flores to document the delivery.
The customer may inspect the exterior condition of the vehicle at the time of delivery and report any issue considered relevant.
As covered exterior damage is included under the comprehensive insurance with no excess, Autos Flores does not require the customer to carry out an exhaustive inspection of minor exterior damage at the beginning or end of the rental.
On return, Autos Flores will mainly check the fuel level, return of keys and equipment, and any relevant incident related to the rental conditions.
Acceptance of the vehicle will not prevent the customer from subsequently reporting an issue that could not reasonably have been detected at the time of delivery.
8. Comprehensive insurance with no excess
The rental includes comprehensive insurance with no excess for covered damage arising from normal and authorised use of the vehicle, provided that the rental conditions are complied with.
No excess means that the customer does not have to pay a fixed initial amount for damage covered by the insurance.
This cover does not apply where damage results from prohibited use or a breach of the rental conditions.
Within the normal and authorised use of the vehicle, the comprehensive insurance with no excess includes own damage arising from:

collision;
-
theft;
-
accidental fire;
-
vandalism.
Cover is subject to compliance with the rental conditions and to the incident being reported to Autos Flores, together with the necessary documentation where applicable.
Expenses that do not constitute damage covered by insurance, such as fines, missing fuel, lost keys or other items expressly provided for in these conditions, may be charged to the customer.
9. Third-party liability insurance
The vehicle is covered by the compulsory third-party liability insurance, which covers personal injury and property damage caused to third parties as a result of the use and circulation of the vehicle, within the limits and conditions established by the policy and applicable legislation.
This cover applies to duly authorised drivers and provided that the vehicle is used in accordance with the rental conditions.
10. Geographical area of use
Autos Flores vehicles are authorised to circulate exclusively within the territory of Andalusia.
This limitation forms an essential part of the rental conditions and is based, among other reasons, on the organisation of the assistance service and Autos Flores’ ability to provide appropriate support in the event of a breakdown, accident or other incident during the rental.
The customer is not authorised to take the vehicle outside Andalusia.
Driving outside Andalusia constitutes a breach of the rental conditions and will result in a penalty of €70 for each day the vehicle remains outside the authorised territory, without prejudice to any additional expenses or liabilities directly resulting from the breach.
Outside Andalusia, Autos Flores does not guarantee the provision of its usual assistance service, and the applicable insurance conditions may vary depending on the policy and circumstances of the incident.
Entering Gibraltar with the vehicle is expressly prohibited.
11. Prohibited uses of the vehicle
The following are expressly prohibited:
-
driving under the influence of alcohol, drugs or substances that impair driving ability;
-
allowing an unauthorised person to drive;
-
reckless, negligent or deliberately damaging use of the vehicle;
-
participation in races, trials, competitions or similar activities;
-
use of the vehicle for unlawful activities;
-
overloading the vehicle or carrying more passengers than permitted;
-
driving on dirt roads, unpaved tracks or roads unsuitable for the vehicle;
-
towing other vehicles, trailers or objects without the express authorisation of Autos Flores;
-
tampering with, altering or dismantling vehicle components without authorisation;
-
tampering with or altering the odometer;
-
subletting, transferring or renting the vehicle to third parties;
-
fitting roof racks, supports or other additional equipment without express authorisation;
-
leaving the vehicle unlocked, improperly secured or parked in a clearly unsafe manner;
-
leaving valuable items visible where this may encourage theft or damage;
-
smoking inside the vehicle;
-
transporting animals in the vehicle.
Autos Flores vehicles are rented without a driver and for the private use provided for in the agreement.
The vehicle may not be used to provide professional or paid passenger transport services, including taxi, private hire/VTC, transport through digital platforms or similar activities.
The vehicle may also not be used for courier services, delivery work, commercial transport of goods, subletting or any professional activity requiring a specific authorisation not included in the rental agreement.
A breach of these conditions may result in the customer being charged for damage, expenses and liabilities directly resulting from the prohibited use, as well as any applicable limitations of insurance cover.
12. Interior damage
Damage caused to the interior of the vehicle as a result of improper, negligent use or use contrary to the rental conditions is not covered by the comprehensive insurance.
Where such damage is attributable to the customer, Autos Flores may charge the reasonable cost of repair, specialist cleaning or replacement of the affected items.
13. Personal belongings
Autos Flores will not be responsible for the loss, theft or damage of luggage, personal belongings, electronic devices, money or other property left or carried in the vehicle by the customer or occupants.
Such items are not covered by the vehicle’s insurance.
14. Accidents, breakdowns and assistance
In the event of an accident, breakdown, damage or any other incident involving the vehicle, the customer must contact Autos Flores as soon as possible and follow the instructions provided.
Autos Flores will assist the customer and take the measures reasonably necessary to resolve the incident, including, where appropriate, roadside assistance, towing, repair or replacement of the vehicle.
Customer assistance will not automatically be excluded merely because the incident may have been caused by an error or action attributable to the driver.
However, where the incident results in expenses directly arising from an error, negligence or improper use of the vehicle by the customer, Autos Flores may charge the reasonable costs incurred.
Such situations may include, among others:
-
refuelling with the wrong type of fuel;
-
loss of or damage to keys;
-
other expenses directly related to a breach of the rental conditions.
15. Towing and roadside assistance
Autos Flores provides roadside assistance and, where necessary, towing services during the rental, in accordance with the applicable conditions.
The fact that an incident may have been caused by an error attributable to the customer does not automatically mean that Autos Flores will cease to provide assistance.
However, where the need for assistance or towing arises directly from an error, negligence or improper use of the vehicle by the customer, Autos Flores may charge the specific reasonable costs directly caused by that action, where appropriate.
16. Alternative transport following an incident
Where, as a result of a breakdown or accident, the customer requires a taxi or other alternative means of transport due to a justified need, Autos Flores may arrange the service directly or ask the customer to provide the receipt for consideration of reimbursement, particularly where the service may be covered by roadside assistance or insurance.
The customer must contact Autos Flores before arranging a taxi or other alternative transport independently, whenever reasonably possible.
If the customer chooses to arrange alternative transport independently without waiting for assistance organised by Autos Flores and without prior authorisation, reimbursement is not guaranteed and will be assessed according to the circumstances.
17. Refuelling with the wrong fuel
If the customer refuels the vehicle with a fuel other than the correct type, they must contact Autos Flores immediately and not continue driving where doing so may worsen the damage.
Autos Flores will provide the necessary assistance and may arrange, where appropriate, immobilisation, towing, repair or replacement of the vehicle.
Where the incident results from incorrect refuelling attributable to the customer, Autos Flores may charge the reasonable costs directly resulting from the error, including, where applicable, fuel extraction, cleaning of the fuel system, repair of affected components or other expenses necessary to restore the vehicle.
18. Reporting accidents and incidents
The customer must report any accident, damage, theft, fire, vandalism or other relevant incident to Autos Flores immediately or as soon as reasonably possible.
Where appropriate, the customer must provide the documentation necessary to process the claim, including an accident report, photographs, third-party details, possible witnesses, a police report or any other reasonably required information.
The customer must cooperate with Autos Flores and the insurance company in the investigation and handling of the claim.
19. Vehicle return and fuel
The customer must return the vehicle at the date, time and place agreed in the rental agreement, unless Autos Flores has previously authorised a change.
The vehicle must be returned with the same fuel level as at the time of delivery.
If the vehicle is returned with less fuel, the customer must pay the amount required to restore the fuel level, plus a €15 refuelling administration charge.
Returning the vehicle outside the agreed time, location or conditions may result in the corresponding charges where these have been previously communicated or are provided for in these conditions.
The customer must inform Autos Flores of any delay or incident that may affect the return of the vehicle.
20. Rental extension
Any extension of the rental period must be requested and expressly authorised by Autos Flores before the date and time originally agreed for the return of the vehicle.
The request may be made by telephone, WhatsApp, email or other usual contact channels, but it will not be considered accepted until Autos Flores has expressly confirmed it.
Any extension is subject to vehicle availability and acceptance of the applicable new financial conditions.
If the customer keeps the vehicle beyond the agreed rental period without prior authorisation, this will be considered a breach of the agreement.
21. Late return and failure to return the vehicle
Where the vehicle is returned late, the customer must notify Autos Flores as soon as possible.
A short delay that has been properly communicated will not, by itself, automatically result in a penalty.
If the customer keeps the vehicle beyond the agreed rental period without prior authorisation, the customer must also pay the additional period of use at the applicable rate, without prejudice to any logistical charges or additional expenses that may apply.
Where the vehicle is not returned at the agreed time without prior authorisation and this forces Autos Flores to carry out additional work to locate the customer, reorganise the fleet, change scheduled deliveries or substitute the vehicle assigned to another booking, a €35 administration charge may be applied for the administrative and logistical costs generated.
This charge will apply particularly where Autos Flores has made reasonable attempts to contact the customer without receiving a response, or where the failure to return the vehicle causes an actual disruption to vehicle planning.
If travel, towing, tolls, storage or other measures are also necessary to recover the vehicle, the reasonable costs directly arising from those actions may be charged to the customer.
In the event of failure to return, disappearance or unjustified retention of the vehicle, Autos Flores may take the legal measures necessary to locate and recover it.
22. Fines, penalties and administration charges
The customer is responsible for fines, penalties, tolls, parking charges or other infringements committed during the rental period.
Where Autos Flores receives a notice relating to an infringement committed during the rental, it may provide the driver’s details to the competent authorities where required by law.
In addition to the amount of the fine or penalty, a €25 administration charge will apply for each fine or penalty processed, corresponding to the administrative work involved in identifying the driver and handling the notification.
This charge does not include the amount of the fine or penalty itself.
23. Extraordinary cleaning
The rental price includes the standard cleaning of the vehicle between rentals.
The customer must return the vehicle in a reasonable state of cleanliness, taking into account normal use during the rental period.
Where the vehicle is returned in a condition requiring extraordinary or specialist cleaning, Autos Flores may apply a charge of up to €150, depending on the work and cost required to return the vehicle to a suitable condition for subsequent rental.
Examples of extraordinary cleaning may include:

excessive animal hair;
-
persistent tobacco odours;
-
significant stains on seats, upholstery or carpets;
-
vomit or other waste requiring specialist treatment;
-
excessive dirt clearly beyond normal vehicle cleaning.
The charge will only be applied where there is a genuine need for additional cleaning and the amount must be proportionate to the work required.
24. Keys, accessories and equipment
The customer must return the vehicle with the keys, documentation, accessories, tools and all other items provided at the start of the rental.
In the event of loss, damage, substitution or failure to return any of these items, Autos Flores may charge the reasonable cost of replacement, repair or substitution, including, where appropriate, programming, travel or administration costs.
In the case of keys, the amount will depend on the vehicle model and the actual cost of replacement or programming.
The cost of any other item supplied with the vehicle that is not returned or is returned damaged for reasons attributable to the customer may also be charged.
25. V16 emergency warning beacon
The V16 emergency warning beacon provided with the vehicle must be returned in good condition at the end of the rental.
In the event of loss, non-return or damage attributable to the customer, a €70 replacement charge will apply.
26. Child restraint systems
Where the customer requires a child seat, booster seat or other approved child restraint system, it must be requested from Autos Flores in advance so that availability can be checked.
Child restraint systems must be used in accordance with the applicable regulations in force at the time.
The customer is responsible for checking that the requested device is appropriate for the child and for using it correctly during the rental.
Autos Flores will provide the device in suitable condition for use but will not accept responsibility for incorrect installation or use by the customer.
The number of child restraint systems that may be requested will be limited by the capacity and configuration of the reserved vehicle. More child seats or booster seats may not be requested than can be safely and properly installed in the vehicle.
27. Repairs and modifications
The customer may not carry out or arrange repairs, modifications or technical work on the vehicle without the prior and express authorisation of Autos Flores.
The customer may not alter, dismantle or modify any part of the vehicle, its keys, documentation, accessories, tools or equipment.
If the customer carries out an unauthorised repair or modification and this results in damage, restoration costs or vehicle immobilisation, Autos Flores may charge the reasonable expenses directly resulting from that action.
28. Customer cancellation and no-show
The customer may cancel or modify the booking free of charge up to 24 hours before the scheduled arrival time, except for vehicles or periods for which special cancellation conditions have been communicated.
Where cancellation is made less than 24 hours before arrival or the customer fails to appear (no-show), Autos Flores may apply a cancellation charge.
As a general rule, the charge will be at least the amount corresponding to one day’s rental, and may be up to the full amount of the booking where justified by the circumstances of the booking, lack of notice or special conditions previously communicated.
Where the booking includes an out-of-hours delivery subject to a surcharge and the customer fails to appear at the agreed time, the surcharge corresponding to that delivery may still be charged, as the necessary staff availability and operational service will already have been arranged.
If a new out-of-hours delivery is subsequently agreed, the corresponding surcharge for the new delivery will also apply.
During Easter, July, August, September and Christmas, bookings for vehicles with more than 7 seats will be subject to the special conditions communicated at the time of booking, with free cancellation up to 5 days before arrival where this has been specified in the booking.
Cancellations or changes must be communicated to Autos Flores through one of the available contact channels so that they can be properly recorded.
29. Early termination by Autos Flores
Autos Flores may terminate the rental agreement early where there is a serious breach of the rental conditions, improper use of the vehicle, a situation that compromises the safety of the vehicle or third parties, or any other circumstance that makes continuation of the rental impossible or inadvisable.
In such cases, the customer must follow Autos Flores’ instructions regarding the return or recovery of the vehicle.
Early termination of the agreement will not prevent Autos Flores from claiming any amounts, damage or expenses that may be due where they arise directly from the customer’s breach.
30. Data protection
Personal data provided by the customer will be processed by AUTOS FLORES PREMIUM, S.L. in accordance with applicable data protection legislation.
The data may be used to manage the booking and rental agreement, provide the contracted services, deal with incidents, manage payments, invoicing and legal obligations, and for any other purposes necessary in connection with the performance of the agreement.

31. Language and translations
These General Rental Conditions were originally drafted in Spanish, which constitutes the contractual reference version.
Autos Flores may provide translations into other languages to help international customers understand the conditions.
Translations must be interpreted in accordance with the content and meaning of the Spanish version and are not intended to modify, extend or limit the rights and obligations established in it.
In the event of any difference in interpretation between a translation and the Spanish version, the Spanish version will be taken into account to the extent permitted by applicable law and without prejudice to the rights granted to consumers under applicable legislation.
32. Applicable law and dispute resolution
The rental agreement will be governed by Spanish law.
Autos Flores will seek to resolve amicably any incident, complaint or dispute arising in connection with the rental.
Where an amicable solution cannot be reached, the competent courts and tribunals will be those determined under the applicable Spanish and European rules, while respecting in all cases the rights granted to consumers and users by law.
Complaints may be addressed to Autos Flores through the contact channels indicated in the rental agreement and on the website.
